If you have two or more prior OWI convictions on your record, any subsequent OWI offense within a certain time period can be charged as a felony. The third OWI offense is a Class D felony, punishable by imprisonment for up to five years, a fine of up to $9,375, and driver's license suspension for six years.

Serious injury refers to injuries that result in substantial risk of death, causes permanent disfigurement, or results in the loss or protracted impairment of any bodily function or organ. OWI causing injury is a Class D felony; however, if the victim is a minor, then the offense is a Class C felony, punishable by imprisonment for up to 10 years and a maximum fine of $13, 660.

If your intoxicated driving leads to the death of another person, you can be charged with a Class B felony. A conviction is punishable by imprisonment for 25 years or 50 years if the victim is a minor.
